2. PROMOTION PERIOD
The Promotion begins on December 11, 2024, at 1:00:01 PM Central European Time ("CET") and ends on December 16, 2024, at 3:59:59 AM CET (the "Promotion Period"). This Promotion is not valid forever.
3. PROMOTION DESCRIPTION: HOW TO PARTICIPATE AND WIN PRIZES >
3.1 HOW TO PARTICIPATE:
During the Promotion Period, log in to your SHEIN account on the SHEIN app or website, follow the instructions and Share the link to the Promotion Page ("Promotion Link") through one of the available social media channels for which you have an account. The link to the Promotion Page must be shared with one of the following platforms: i) your Instagram feed, ii) your Snapchat, or iii) your Twitter (X) feed. Sharing the link to the Program Page on Facebook or via direct messages is not permitted. Sharing the link to the Program Page is limited to one time per person during the Program Period.
You must be logged in to your SHEIN account on the SHEIN website or app to participate in the Promotion. Maximum one (1) entry per person, regardless of the number of entries. To participate, you must have an Instagram, Snapchat, or X (Twitter) account and your account must be public. Accounts are free. All entries are subject to the Instagram, Snapchat, or X (Twitter) Terms of Service. The use of macros, bots, scripts, or other automated means to submit entries is prohibited. Proof of entry is not proof of receipt. The organizer's database computer is the official timing device for the campaign. Entries will not be accepted or returned. In the event of a dispute regarding the identity of an entrant, the entry will be deemed submitted by the relevant account holder of the email address associated with the social media account used to post the entry. “Relevant account holder” means the natural person associated with an email address or similar account linked to the relevant social media account.
Anyone who has created or used multiple accounts to enter the promotion is ineligible and their entry is void. Anyone who tweets more than once to enter the promotion is ineligible and their tweets are invalid.
3.2 Raffle and Winner Announcement:
During the promotion period, a random drawing will be held once each qualified participant has successfully shared their entry. The raffle results will also be announced immediately and displayed to participants. Seven hundred (700) winners will be randomly selected. No liability is assumed for winner notifications that are lost, intercepted, or not received by the potential winner for any reason. If a potential winner is found to be ineligible, has not complied with these Official Rules, or declines a prize for any reason prior to awarding, such potential winner will be disqualified, and an alternate winner may be selected. Furthermore, if a potential winner does not respond within two days of the first notification attempt, or if the prize or prize notification is returned to the potential winner as unclaimed or undeliverable, such potential winner may be disqualified, and an alternate winner may be selected. A potential winner may be required to submit an affidavit of eligibility, a liability release, and a publicity release ("Prize Claim Documents").
3.3 PRIZE AND ODDS:
There are seven hundred (700) prizes available. Each prize consists of a €10 SHEIN gift card (the “€10 Gift Card”). The prize will be credited to the winner's SHEIN account and can be viewed in the Gift Card section of the winner's SHEIN account. The €10 gift card can only be used to purchase SHEIN products at https://nl.shein.com or in the SHEIN app. The €10 gift card cannot be used to pay taxes or shipping costs. The €10 gift card expires on December 31, 2024.
Odds of winning depend on the number of eligible entries received. The prize is non-transferable, and no cash alternative or substitution is permitted except with the permission of the Organizer. If the stated prize is no longer available for any reason, a substitute of comparable or greater value may be provided. Each winner is responsible for all federal, state, and/or local taxes, and any other fees or costs associated with the acceptance or use of a prize.
All participants will receive twenty (20) SHEIN points (the 20 SHEIN points) when they share the link to the promotion page on their Instagram feed, Snapchat story, or Twitter (X) feed. SHEIN points will be credited to the participant's SHEIN account and are valid for 30 days after issue.
4. PRIZE CONDITIONS
All prizes must be properly stored by the users after issue. Participants must protect their SHEIN account and password to prevent prizes from being used by others. The organizer is not liable for any loss or misappropriation. All prizes can be used on all SHEIN platforms (app and website) in the country where the winners reside. >
Unless otherwise stated, prizes are non-transferable and cannot be redeemed for cash. Prizes are void where prohibited by law. The Organizer may delay awarding a prize for investigation purposes and may refuse to review and process any transaction that the Organizer, in its sole discretion, deems fraudulent, suspicious, or in violation of these Rules. All decisions of the Organizer are final and binding. >
If required by law, the prize winner may be required to sign a prize acceptance form provided by the Organizer.
5. GENERAL
5.1. Penalty for Violations >
The Organizer reserves the right to prohibit you from participating in the Promotion and/or using SHEIN's services, or to permanently ban you from any other Promotion if it determines, in its sole discretion, that you have engaged in any of the following actions demonstrated during the Promotion:
1. If you have engaged in fraudulent behavior (including, but not limited to, attacking the system, obtaining inappropriate benefits, illegally using modified software, cloning, jailbreaking, rooting, etc.);
2. If you have violated any of the Promotion Rules and/or a SHEIN Services Agreement;
3. If you have created multiple or fake user accounts, as evidenced by data, transaction order information, payment information, and other information relating to the user's identity and behavior.
5.2. Conditions of Participation
By participating in the Promotion, you confirm that you are over 18 years of age and agree to the following:
(i) that you will comply with these Rules, including all Conditions of Participation, and
(ii) in the event of any dispute arising in connection with the Promotion or winning a prize, you agree to abide by the decisions of the Promotion Judges, who are final and binding in all matters relating to the Promotion.
Registration material/data that has been tampered with or altered is void.
The Organizer assumes no responsibility for: (i) lost, late, misdirected, damaged, inaccurate, incomplete, or illegible entries, all of which are invalid; (ii) errors, omissions, interruptions, deletions, defects, delays in operation or transmission, theft or destruction or unauthorized access to or alteration of entry materials or technical, network, telephone, electronic, mobile, computer, hardware, or software malfunctions of any kind or inaccurate transmission or non-receipt of entry information by the Organizer resulting from technical problems; or (iii) any injury or damage to the participant's or any other person's computer or mobile device related to or resulting from participation in the Promotion.
The Organizer reserves the right to suspend, modify, or terminate the Promotion if, in its sole discretion, it believes that any malfunction, error, disruption, or damage compromises or will compromise the administration, security, fairness, integrity, or proper conduct of the Promotion. In such cases, if the Promotion is terminated prior to the specified end date of the Promotion Period, the Organizer will (where possible) select the winner from all eligible, non-suspect entries that are not affected by the problem.
5.3. Publication/Usage Rights
If participation in the Promotion requires you to upload a post (feed post, story, or otherwise) to your social media accounts as a condition of entering or winning the Contest, you hereby grant a perpetual, worldwide, non-exclusive license to do so. The Organizer (and those acting with its permission) are permitted to copy your entry, in whole or in part, in any form and on any medium, now existing or later created, for the purpose of publishing or distributing, reproducing, editing, transmitting, and otherwise using your post online on our social media channels, website, or online magazines. Please note that you may revoke this license at any time by contacting the SHEIN Customer Center. To fulfill our obligations under these Official Rules, we will use your full name, contact information, and address to administer the Promotional Event. This includes determining the winners, conducting necessary communication with participants, and organizing the logistics and delivery of the prize. We may also disclose the winners' information described above, if required by applicable local regulations.
5.4. Release
By participating in the Promotion, you release the Promoter, the Promoters, and their employees from all liability for any injury, loss, or damage caused or alleged to be caused by your participation in the Promotion and/or acceptance, award or receipt, use and/or misuse of the prizes, and you agree that such companies are not responsible for any express or implied warranty, representation, or guarantee, in fact or in law, in connection with the Promotion and/or the awarding of any prize, unless expressly stated otherwise.
You further agree that: (a) all disputes, claims, and causes of action arising out of or connected with the Promotion or the prizes awarded shall be resolved individually, without resort to any form of class action; (b) All claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Promotion, but not including attorneys' fees. (c) Under no circumstances may an entrant obtain a prize by tort, and entrant hereby waives all rights to claim punitive, incidental, or consequential damages, and all rights to have damages multiplied or otherwise increased, other than damages for actual damages and out-of-pocket expenses; and (d) these Rules and any disputes shall be governed by the laws of the Netherlands, without regard to its conflict of law principles; All disputes will be resolved exclusively in the Netherlands, and you expressly consent to the jurisdiction of said courts and waive any objection thereto. By participating, you release Instagram, SnapChat, Twitter, and their parent companies, subsidiaries, affiliates, partners, employees, directors, agents, and advertising agencies from all liability for any injury, loss, or damage caused or allegedly caused by your participation in the promotion and/or the acceptance, award, receipt, use, and/or misuse of the prize. 5.6. Taxes
To the extent permitted by law, all taxes applicable to any prizes provided by the Organizer are your responsibility, and the Organizer will not bear any costs for any tax liabilities.
