Ltd. and its subsidiaries, and “you” or “your” refers to the person or entity that submits images, designs, text, or other content (“Content”) for use in customized products on www.shein.com or purchases such products. If you wish to purchase personalized products on www.shein.com, you must accept these Terms and Conditions.
BY CLICKING THE "PERSONALIZE NOW" BUTTON OR PLACING YOUR ORDER FOR PERSONALIZED PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING, BUT NOT LIMITED TO, THE SHEIN PRIVACY POLICY AND THE SHEIN TERMS AND CONDITIONS WHICH MAY BE CHANGED FROM TIME TO TIME
1. Content: You may submit your own design or choose from a gallery of designs and images to create personalized products. You may only submit designs that comply with SHEIN's TERMS AND CONDITIONS. These designs may not contain pornographic, defamatory, libelous, unlawful, obscene, or racially, ethnically, or otherwise objectionable content and must also comply with applicable laws (including intellectual property laws). We expressly reserve the right to reject designs that violate our rules.
2. License Grant for Your Content: You hereby grant to SHEIN, its affiliates, and licensors (including third parties that provide customized products and related services) (collectively, the “Customization Providers”) a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, perform, translate, and create derivative works in connection with the creation and your purchase of customized products. (including the names and likenesses of all people appearing in the content).
Please note that we use your content solely to provide services and fulfill your individual orders. We will not use, sell, or distribute your uploaded content or personal information for any other unauthorized purposes.
3. Representations, Warranties, and Indemnities: You represent and warrant that you have the right to grant the licenses set forth in these Terms and Conditions; that the use of such content by the Custom Work Providers does not infringe, misappropriate, or otherwise harm any person or entity's intellectual property rights; and that you will defend and indemnify the Custom Providers against all losses, damages, judgments, settlements, expenses, interest, and other liabilities (including reasonable attorneys' fees and costs) relating to or arising from any accusation, claim, action, or proceeding brought by either party (a "Claim") to the extent such Claim is based on a violation of these Terms and Conditions;
4. Resale Prohibition: It is prohibited to offer for sale or otherwise make available personalized products, in whole or in part, directly or indirectly, through online or offline channels, at any location. The Customization Service is intended solely for the purchase of products, and you agree not to use the Service to conduct business as a product seller or for any other business use or purpose, unless expressly authorized in writing by SHEIN. To avoid potential risks, you should not order more than 10 personalized products at a time. And violating the resale prohibition may result in claims for damages and legal liability to you.
5. SHEIN Intellectual Property:You may not use SHEIN intellectual property in any way without SHEIN's prior written consent. These Terms and Conditions and your purchase of custom-made products do not grant you any rights to such intellectual property (including photographs, illustrations, graphics, text, designs, or images provided to you for your purchase).
6. Returns: Custom-made products cannot be returned or exchanged unless we deliver incorrect custom-made products (for example, if you receive custom-made products with samples that are not yours).
7. Amendments: We may amend these Terms and Conditions at our sole discretion by posting the amended Terms and Conditions on the SHEIN.com website. By continuing to purchase custom-made products on SHEIN.com after the revised Terms become effective, you agree to the revised Terms.
